Victory for Plastic Surgeons Nationwide in Federal Court Ruling
The dismissal of a lawsuit filed by a group of “cosmetic surgeons” against the Utah Plastic Surgery Society (UPSS), the American Society of Plastic Surgeons (ASPS), the American Board of Plastic Surgery (ABPS), and 19 specific plastic surgeons, alleging that their patient-safety advertisements were tantamount to attempting to form a monopoly, has been upheld by the 10th District U.S. Court of Appeals. The suit asserted that advertising run by the UPSS modeled on the ASPS’ Do Your Homework campaign violated both the Sherman Antitrust Act and the false advertising statute of the Landham Act. At the heart of the complaint was the idea that by suggesting cosmetic surgery is safer when performed by ABPS-certified plastic surgeons, as opposed to “cosmetic surgeons”, the UPSS was being deceptive. The court decided that the plaintiffs failed to show any reasonable instances of antitrust or deceptive advertising violations and ruled in favor of the defendants. The decision served to implicitly confirm the legitimacy of the distinction between board-certified plastic surgeons and lesser-trained practitioners.
